“12. (1) A person contravenes section 6 only if a computer system located in Canada is used to send or access the electronic message.”

This is also referenced in the Canadian FAQ:
Does section 6 of CASL apply to messages sent outside of Canada?
For section 6 of CASL to apply, a computer system located in Canada must be used to send or access the CEM.

The American Bar Association says “CASL will apply if an e-mail is sent from the United States to a Canadian who receives and opens it on a computer located in Canada.”
